Caribee App - Terms & Conditions of Use

Terms and Conditions of Use | Caribee | Financial Year: 2025

Please read these Terms and Conditions (“Terms”) carefully before using the Caribee mobile application or any of its services (“App”). By downloading, accessing, or using Caribee, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the App.

1. Who are we?

Caribee is a digital tourism platform operated by Xamayca Ltd, a company registered in the United Kingdom, focused on enhancing Caribbean travel experiences through curated content, local partnerships, and smart navigation tools.

 

For data protection purposes, we are a Data Controller under both the UK GDPR and the Jamaica DPA.

2. Eligibility 

You must be at least 16 years old to use the Caribee App. By using the App, you confirm that:

  • You are over 16; or

  • You have the consent of a parent or legal guardian.

We reserve the right to suspend or terminate access if we believe you are underage or using the App in breach of applicable law.

3. User Accounts

You may be required to register an account to access certain features. You agree to:

  • Provide accurate, current, and complete information;

  • Maintain the confidentiality of your login credentials;

  • Be responsible for all activity under your account.

We reserve the right to suspend or delete accounts that violate these Terms or our Acceptable Use Policy.

4. Acceptable Use

You agree not to:

  • Use the App for unlawful or fraudulent purposes;

  • Post, share, or transmit any harmful, offensive, or misleading content;

  • Impersonate another person or misrepresent your affiliation;

  • Interfere with the integrity or performance of the App or its data;

  • Attempt to gain unauthorised access to our systems.

We reserve the right to investigate and take legal action against violations.

5. Content and Intellectual Property

a. Our Content:

All intellectual property in the App (including logos, graphics, text, and software) is owned by or licensed to Caribee. You may use the App for personal, non-commercial use only.

b. Your Content:

If you post or upload reviews, photos, or content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and share that content in connection with the App and our marketing.

You represent that you have all necessary rights to grant this licence and that your content does not infringe third-party rights.

6. Bookings and Third-Party Services

Caribee may facilitate bookings or access to services provided by third parties (e.g. tours, taxis, vendors).

  • We are not responsible for the performance, safety, legality, or quality of any third-party service;

  • Your agreement for those services is directly with the third-party provider;

  • You should review their terms and privacy policies separately.

Caribee does not act as agent or principal unless explicitly stated.

 

7. Pricing and Payments

Where payments are made through the App:

  • Prices will be shown in the relevant currency;

  • You agree to pay all applicable charges at the time of booking or purchase;

  • Third-party payment processors may be used, and we are not liable for issues arising from their service.

Some features may be free; others may be subject to fees, subscriptions, or in-app purchases.

8. Cancellation and Refund Policy

Where Caribee facilitates a booking, the cancellation and refund terms of the third-party vendor will apply.
We may support dispute resolution but are not responsible for issuing refunds unless expressly stated.

9. Privacy and Data Protection

Your personal information will be processed in accordance with our Data Privacy Policy, which complies with:

  • The UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018; and

  • Jamaica’s Data Protection Act, 2020.

By using the App, you consent to the collection and processing of your data as described.

10. Location Services and Permissions

With your consent, the App may use GPS or location data to enhance your experience. You can disable this in your device settings, though certain features may not work as intended.

 

11. Disclaimers

Caribee is provided “as is” and “as available” without warranties of any kind, express or implied.
We do not guarantee:

  • Uninterrupted or error-free operation;

  • That the App or server is virus-free;

  • That content will be accurate, current, or complete.

You use the App at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Caribee and Xamayca Ltd shall not be liable for:

  • Any indirect, incidental, or consequential losses;

  • Loss of data, revenue, or profits;

  • Losses arising from third-party services, network failures, or external factors.

Our total liability to you, for any reason, shall not exceed £100 or the amount you paid through the App in the last 12 months (whichever is greater).

Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence.

13. Suspension and Termination

We may suspend or terminate your access to the App:

  • If you breach these Terms;

  • If we are required to by law or court order;

  • If we discontinue the App (with reasonable notice).

Termination does not affect any accrued rights or obligations.

14. Changes to these Terms

We may update these Terms periodically. When we do:

  • We will update the “Effective Date” above;

  • Continued use of the App after notice of changes constitutes acceptance.

If you do not agree with the updated Terms, you must stop using the App.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms, your use of the Caribee App, or any related services.

Nothing in this clause affects any mandatory consumer protections or data rights you may be entitled to under the laws of your country of residence.
